Calling For An Overdose

Mo. Rev. Stat. § 195.205 — no arrest for possession, underage alcohol or a probation violation found by seeking help

In Missouri, a person who in good faith seeks or obtains medical help for someone's drug or alcohol overdose or other medical emergency, or the person in the emergency, is not arrested, charged, prosecuted, convicted, subjected to civil forfeiture or otherwise penalized for these, when the evidence was gained because help was sought:

  • Possession of a controlled substance or paraphernalia, under the sections listed.
  • The underage alcohol offenses listed.
  • Violating a restraining order.
  • Violating probation or parole.

Medical help includes reporting to police, 911, poison control or a medical provider, and caring for the person while help is on the way. It does not prevent an arrest on an outstanding warrant, or for other offenses.
