Possessing A Controlled Substance

Mo. Rev. Stat. § 579.015 — a class D felony outside the statute's marijuana tiers

A class D felony. Knowingly possessing a controlled substance in Missouri, except as chapters 579 and 195 authorize, is a class D felony, apart from the marijuana and synthetic cannabinoid amounts the section grades separately.

This page leaves the marijuana amounts out. Adult possession of marijuana is governed by Article XIV of the Missouri Constitution, which this guide does not cite, and the statute's marijuana tiers cannot be read correctly without it. A person charged has the burden of proving any exception or exemption in the chapter.
