Handing Over A Firearm
Mo. Rev. Stat. § 571.060 — transferring a firearm to someone not lawfully entitled to possess one is a class E felony
To a prohibited person. A person commits unlawful transfer of weapons by knowingly selling, leasing, loaning, giving away or delivering a firearm or ammunition to a person who is not lawfully entitled to possess it under the state's prohibited person section. It is a class E felony.
To a minor, or someone intoxicated. Recklessly delivering any firearm to a person less than eighteen years old without the consent of the custodial parent or guardian, or recklessly delivering a firearm or ammunition to an intoxicated person, is a class A misdemeanor. Delivery to a peace officer or a member of the Armed Forces or National Guard on duty is not prohibited.
Federal law adds its own rules on transfers, including to people who live in another state, which are not on this page. Whether a particular sale, loan or gift is lawful is a question for a licensed Missouri attorney.
