When The Storage Unit Is Sold

Mo. Rev. Stat. § 415.415 — more than forty five days in default, then a commercially reasonable sale

In Missouri, a storage operator has a lien on the property in each leased space for rent and related charges, and the rental agreement states in bold type that the property may be sold if the occupant defaults.

Forty five days. If the occupant is in default for more than forty five days, the operator may enforce the lien and sell the property for cash, at a public or private sale, in a commercially reasonable manner.

Any surplus is held for the occupant on demand for one year, and unclaimed proceeds go to the state treasurer. The section sets the notice and redemption rules, which are not reproduced in full here. Whether a sale was lawful is a question for a court and for a licensed Missouri attorney.
