Where Nobody May Smoke

Mo. Rev. Stat. § 191.767 — no smoking in a public place or public meeting except in a designated smoking area

The rule. A person may not smoke in a public place or in a public meeting except in a designated smoking area.

Who designates. A smoking area may be designated by the persons having custody or control of a public place, except where smoking is prohibited by the fire marshal or by other law, ordinance or regulation.

Thirty percent. No public place may have more than thirty percent of its entire space designated as a smoking area.

Restaurants. The proprietor or person in charge of a restaurant designates a nonsmoking area of sufficient size to accommodate the usual and customary demand for one.

State workplaces. Each state executive department and institution of higher education provides a designated smoking area for state employees during the work day, where it can be adequately ventilated at minimum cost.
