A Death Somebody Caused
Neb. Rev. Stat. § 30-809 and Neb. Rev. Stat. § 30-810 — an action by the personal representative within two years
When a death is caused by the wrongful act, neglect or default of another, in a way that would have let the injured person sue had they lived, the one responsible is liable in an action for damages.
Two years. The action is brought within two years after the death, by the personal representative, for the exclusive benefit of the widow or widower and next of kin.
Any settlement needs the approving court's consent, and the recovery is divided by each person's share of the financial loss. A particular claim is a question for a licensed Nebraska attorney.
