A Small Estate

Neb. Rev. Stat. § 30-24,125 — personal property of one hundred thousand dollars or less, collected by affidavit after thirty days

After thirty days. Thirty days after a death, anyone owing the person money or holding their personal property pays or delivers it to a successor who presents an affidavit.

  • All the personal property in the estate, less liens, is worth no more than one hundred thousand dollars.
  • Thirty days have passed since the death, shown by a certified copy of the death certificate.
  • The successor's relationship to the person, or the basis of the claim.
  • No application or petition for a personal representative is pending or granted.

Those are among what the affidavit states, under penalty of perjury. Real estate goes through other procedures. Whether a particular estate qualifies is a question for a licensed Nebraska attorney.
