Calling For An Overdose
Neb. Rev. Stat. § 28-472 — a good faith call, staying on the scene, and no possession or paraphernalia charge
- The person made a good faith request for emergency medical help for an overdose, their own or another's, as soon as it was apparent.
- The evidence was found because of the overdose and the request for help.
- Calling for another person, the caller stayed on the scene until help or police arrived, and cooperated.
No possession or paraphernalia charge. Where those conditions are met, the person is not in violation of the possession or paraphernalia sections, and neither is the person who was overdosing.
The exception does not reach drug-induced homicide or any other offense. A particular case is a question for a licensed Nebraska attorney.
