Neb. Rev. Stat. § 60-6,378 — a lane apart from a stopped vehicle on a controlled-access highway, or slow down

A lane apart. On a controlled-access highway with at least two lanes in the same direction, a driver approaching or passing a stopped vehicle on the same side moves into a lane at least one moving lane apart from it, unless directed otherwise.

Where there is no second lane, or moving over is not reasonably possible, the driver slows, keeps a safe speed for the conditions and proceeds with due care and caution.

A violation is a traffic infraction, and a Class IIIA misdemeanor for a second within five years. The rule does not apply to a stopped vehicle with no one in or near it.
