Getting Public Records
NRS 239.0107 — an answer by the end of the fifth business day
A written or oral request is enough. Not later than the end of the fifth business day after the custodian receives it, the government entity does one of four things.
- Lets the person inspect or copy the record, or provides the copy
- Says in writing that it does not have the record, and names the entity that does, if known
- Says in writing that it cannot make the record available yet, gives the earliest date and time it expects to, and helps focus the request
- Denies the request in writing because the record is confidential, citing the specific statute or authority that makes it so
If the record is not ready by the date given, the entity explains why in writing and gives a new date. A record readily available is provided as expeditiously as possible.
