NRS 616C.015 and NRS 616C.020 — written notice to the employer within 7 days, and a claim within 90
Notice within 7 days. An injured Nevada employee gives the employer written notice of an injury that arose out of and in the course of employment as soon as practicable, but within 7 days after the accident. If the employee died, one of the dependents gives it.
The notice is on the Administrator's form, which lets the employee describe the accident briefly and explains how to file a claim. It is signed by the employee or someone on the employee's behalf, made in duplicate so each side keeps a copy, and signed by the employer or supervisor on receipt. That signature acknowledges receipt and waives none of the employer's defenses. The employer keeps it 3 years.
The claim within 90 days. An employee who sought medical treatment for the injury, or was off work because of it, files a claim for compensation with the insurer within 90 days after the accident. A dependent files within 1 year after a death caused by the injury.
Missing either filing bars recovery, unless the insurer excuses it because the injury or another cause beyond the employee's control prevented it, it was a mistake or ignorance of fact or law, it came from physical or mental inability, or it was caused by fraud, misrepresentation or deceit.
A leased employee may give notice to the client company's supervisor. Choice of physician, benefits and appeals are in other sections of the chapter and are not reproduced here. Whether a particular injury is covered is for the insurer, the hearing officers, a court and a licensed Nevada attorney.
