Suspended Or Expelled

NRS 392.467 — notice and a chance at a hearing first, and no expulsion under 11 but in extraordinary cases

No pupil may be suspended or expelled until given notice of the charges, an explanation of the evidence, and an opportunity to schedule a hearing. A pupil who poses a continuing danger, an ongoing threat of disruption, is selling drugs, or has a firearm or dangerous weapon may be removed immediately with an explanation, and the proceedings follow as soon as practicable.

Not for missing school. No pupil may be suspended, expelled or removed solely for attendance offenses or for being declared a truant.

These hearings are closed to the public. A pupil with a disability may be suspended for not more than 10 days for each occurrence, after a review that the action complies with federal disability education law.
