Moving Over For Stopped Vehicles
N.J.S.A. 39:4-92.2 — a lane away from flashing lights, or under the limit and ready to stop
In New Jersey, a driver approaching any stationary vehicle displaying flashing or blinking lights approaches with due caution and, unless an officer directs otherwise, changes into a lane not next to it if conditions allow. Where a lane change is impossible, prohibited or unsafe, the driver slows to a reasonable and proper speed below the posted limit and is prepared to stop.
A violation carries a fine of $100 to $500. Three or more offenses within a 12-month period also bring two motor vehicle points, and only where the stopped vehicle was showing its lights at the time of the third.
