The Equipment Stop
N.J.S.A. 39:3-47 — lighted lamps when required, a fine not to exceed $50.00, and no points
When. Lighted lamps are required any time from a half-hour after sunset to a half-hour before sunrise; whenever rain, mist, snow or other precipitation or atmospheric moisture requires the use of windshield wipers; and any time there is not sufficient light to render clearly discernible persons and vehicles on the highway at a distance of 500 feet ahead.
The fine, and no points. Failure to use lighted lamps when they are required may result in a fine not to exceed $50.00. No motor vehicle points or automobile insurance eligibility points are assessed for it, and a person fined is not subject to a surcharge under the Merit Rating Plan.
Working lamps. A lamp described as approved must be in good working order and capable of operating at least 50% of its designed efficiency.
Altered equipment. No person alters the equipment of a vehicle approved at an official inspection station with intent to defeat the purpose of the inspection, or drives a vehicle with equipment so altered.
Other equipment the code requires, from brakes to mirrors, is set out in other sections that are not on this page. Whether a lamp was out, or the conditions called for lights, is a question of fact, and whether a stop on that basis was lawful is a question for a licensed New Jersey attorney.
