Where Nobody May Smoke
N.J.S.A. 26:3D-58 — indoor public places, workplaces, public parks and beaches
Where smoking is prohibited. An indoor public place, a workplace, a public park or beach, and the outdoor passenger pick-up and drop-off area of an airport not owned or operated by a federal or military authority. Smoking is also prohibited in any building of, and on the grounds of, any public or nonpublic elementary or secondary school, indoors or out.
- Qualifying cigar bars and lounges, and tobacco retail establishments.
- Private homes, private residences and private automobiles.
- The area within the perimeter of a qualifying casino or casino simulcasting facility.
- Approved research facilities studying the health effects of smoking.
Those exceptions are where the act does not apply. The rest of an indoor public place or workplace falls under the prohibition.
