The rates are per hour worked and bind every employer regardless of size. Where federal law sets a higher wage, the higher one applies.
After 2026, by inflation. On and after January first, two thousand twenty-seven, each rate is the adjusted rate the commissioner establishes every year, raised by the change in a consumer price index for urban wage earners in the northeast and rounded to the nearest five cents.
