Penal Law § 190.78 — identity theft in the third degree, a class A misdemeanor
In New York, knowingly and with intent to defraud assuming another person's identity, by presenting oneself or acting as them or by using their personal identifying information, and thereby getting goods, money, property or services, using credit in their name, causing a financial loss, or committing a class A misdemeanor or higher crime, is identity theft in the third degree, a class A misdemeanor.
