Alimony

G.S. 50-16.3A — a dependent spouse, a supporting spouse, and an award that is equitable

In North Carolina, either party may ask for alimony. The court awards it on finding that one spouse is a dependent spouse, the other a supporting spouse, and that an award is equitable after considering all relevant factors.

Marital misconduct decides it outright. If the dependent spouse engaged in illicit sexual behavior during the marriage and on or before the date of separation, the court does not award alimony. If the supporting spouse did, the court orders alimony paid to the dependent spouse. If both did, the court decides in its discretion. Behavior the other spouse condoned is not considered.

The alimony claim may be heard before a judgment on equitable distribution.
