Assault
G.S. 14-33 — a Class 2 misdemeanor, and Class A1 with serious injury or a deadly weapon
In North Carolina, a simple assault, a simple assault and battery, or taking part in a simple affray is a Class 2 misdemeanor.
- Inflicting serious injury or using a deadly weapon.
- A male at least 18 years of age assaulting a female.
- Assaulting a pregnant woman, or a child under the age of 12 years.
- Assaulting a state or local government officer or employee doing their duties.
- Assaulting a school employee or volunteer in connection with their duties.
Class A1. Any of those makes an assault a Class A1 misdemeanor, unless another law punishes it more severely. Assault and battery on a sports official at an event, or an assault on an identifiable utility or communications worker on duty, is a Class 1 misdemeanor.
