G.S. 20-4.01 — an operator is in actual physical control of a vehicle that is moving or has the engine running
The operator. An operator is a person in actual physical control of a vehicle which is in motion or which has the engine running. The terms operator and driver are synonymous.
Whether a person parked with the engine off, or asleep in the seat, was in control of the vehicle is decided on the facts of the case, and is a question for a licensed North Carolina attorney.
