Tobacco and Vapes for Minors

G.S. 14-313 — the state line is 18, for the seller and the buyer alike

Distributing tobacco products, vapor products or cigarette wrapping papers to anyone under 18, or buying them on that person's behalf, is a Class 2 misdemeanor. A seller with reasonable grounds to think a buyer is under 18 must ask for photo ID with a date of birth, and not asking is itself a Class 2 misdemeanor if the buyer was under 18.

A person under 18 who buys or tries to buy these products, or shows false proof of age to do it, is guilty of a Class 2 misdemeanor too, and so is anyone who sends a person under 18 to buy them. Vending machines are limited to places open only to adults or under the owner's continuous control, and online sellers verify age through an independent service.

This page covers the state statute, whose age is 18. Federal law sets its own minimum age for sales, which is not covered here. A particular charge is a question for a licensed North Carolina attorney.
