A Day of Rest in Retail
N.D.C.C. § 34-06-05.1 — a retail employer may not require seven days straight
- In a business that sells merchandise at retail, an employer may not require an employee to work seven consecutive days.
- Each seven-day period carries at least twenty-four consecutive hours off for rest or worship, on top of the usual daily breaks.
- An employee who asks off for one regular worship service a week may not be required to work then, unless honoring it would bring substantial economic burden or the employer made a reasonable effort to accommodate.
- A violation is a class B misdemeanor, but it is a defense that the employee volunteered for the seventh day in a signed written statement.
