Carrying a Gun

N.D.C.C. § 62.1-04-02 — someone not barred from a class 2 license, with a valid driver's license or ID, may carry concealed

No one but a law enforcement officer may carry a firearm or dangerous weapon concealed unless licensed or exempted. One exemption is broad: an individual not otherwise barred from holding a class 2 firearm and dangerous weapon license, who has a valid driver's license or nondriver ID, may carry a firearm concealed.

  • Without a license or that exemption, a handgun may be carried only unloaded and in plain view or secured, outside one's own land, home or business.
  • A loaded firearm in a motor vehicle is an infraction, except for a license holder, or for someone not barred from a class 2 license who has a valid driver's license or ID.
  • Carrying under the exemption, the individual tells an officer about a concealed firearm if asked, and shows the driver's license or ID on request.

Whether someone is barred from a class 2 license turns on the license's own conditions and the list of people who may not possess firearms. A particular situation is a question for a licensed North Dakota attorney.
