Child Support

N.D.C.C. § 14-09-09.7 — the guideline amount is presumed correct, and support can run to nineteen in high school

The department sets child support guidelines based on gross income. The amount the guidelines produce is presumed correct, and the presumption is rebutted only on a preponderance of the evidence with a written finding.

  • Support ordered until majority continues to the end of the month the child graduates from high school or turns nineteen, whichever comes first, while the child is eighteen, attending high school and living with the parent owed support.
  • That parent files a declaration with the child support agency, for no fee, for it to resume.
  • Unless the order sets dates, support starts the month the order is signed and runs to the end of the month the obligation ends.
