Railroad Crossings
N.D.C.C. § 39-10-41 — stop within fifty feet of the rail, and no closer than fifteen, when a train signals or is near
A driver stops within fifty feet but not less than fifteen feet from the nearest rail, and does not go until it is safe, when any of these is true:
- A signal device warns of an approaching train.
- A crossing gate is down or a flagger signals.
- A train sounds within about one thousand three hundred twenty feet and is an immediate hazard.
- An approaching train is plainly visible and in hazardous proximity.
On any highway, no one may leave glass, nails, cans or other litter, and someone who drops injurious material removes it at once, as does whoever tows away a wreck.
