N.D.C.C. § 39-08-23 — no composing, reading or sending an electronic message while driving in traffic
The operator of a motor vehicle that is part of traffic may not use a wireless communications device to compose, read or send an electronic message. Traffic includes a temporary stop, such as at a light or sign, but not a vehicle lawfully parked.
- Dialing or answering a call, voice commands, and hands-free use are not electronic messages.
- Entering or reading a GPS or other navigation device is allowed.
- Getting emergency help, reporting a crash or a serious hazard, or preventing a crime is allowed.
Under 18, no talking either. A driver at least sixteen and under eighteen with a class D license may not use an electronic communication device to talk, compose, read or send while the vehicle is moving, except to get emergency help or prevent a crime.
