Stalking and Harassment
N.D.C.C. § 12.1-17-07.1 — two or more acts that frighten, intimidate or harass, or tracking someone's location, a class A misdemeanor
Stalking is an intentional course of conduct, two or more acts, directed at a person or the person's immediate family, that would frighten, intimidate or harass a reasonable person and serves no legitimate purpose. Tracking someone's location by GPS or other electronic means for no legitimate purpose is stalking too.
- Contacting or following someone after being told they want no contact is prima facie evidence of intent to stalk.
- Stalking is a class A misdemeanor, and a class C felony with certain prior convictions.
- Harassment, with intent to frighten or harass, includes repeated calls or messages with no legitimate purpose, anonymous or coarse calls, and posting someone's personal identifying information online.
- A written or electronic threat to injure a person, a reputation or property is a class A misdemeanor; the other kinds of harassment are class B.
