Bulk Amount
ORC 2925.01 — the number every drug charge turns on
Almost every Ohio drug charge is decided by weight, and the weight is measured against something called the bulk amount. Read the possession or trafficking tables without knowing what that means and the numbers are meaningless.

- Bulk amount is not one number. It is defined separately for each substance and depends on what the drug is and what form it is in.
- For most compounds it is set by grams, and for others it is set by the number of unit doses, which is why the tables show both.
- The tiers are multiples of it. Under bulk, bulk to five times bulk, five to fifty, fifty to a hundred, and a hundred or more.
- Crossing a multiple changes the felony degree. The same drug, the same conduct, one gram more, and the sentencing guidance changes with it.
- Which schedule a substance falls in is a separate list again, and that list gets amended.
The weight is the whole mixture, not the drug in it. Ohio counts the compound, mixture, preparation, or substance containing the drug. That is why the number on a lab report is often far larger than anyone expects, and it is the single most common surprise in a drug case.
Cocaine, heroin, fentanyl related compounds, marijuana, hashish, LSD, and controlled substance analogs are pulled out of the bulk system and given their own gram figures, which is why they each get their own row in the tables rather than sharing one.
A substance that is only represented to be a drug still counts for trafficking purposes. Selling something fake is charged under the same section.
