Trafficking By Amount

ORC 2925.03 — one degree up, and the enhancements on top

Trafficking is the same substances and the same weight tiers, charged a degree or more higher, with a second column that goes higher still when an enhancement applies. It also does not require a completed sale. Preparing for shipment, or possessing with intent, is enough.

The enhancement is proximity, and it is wider than people think. The higher column applies when the offence happened in the vicinity of a school or of a juvenile. A 2022 amendment extended the same enhancement to trafficking near a substance addiction services provider, within five hundred feet of one, or to a person the offender knows is in or recently out of treatment.
  • Heroin, fentanyl related compounds, LSD, hashish, and controlled substance analogs each have their own trafficking table with the same structure.
  • Manufacturing and cultivation is a third section again, and for methamphetamine it carries its own mandatory minimum years.
  • Assembling or possessing the chemicals to make a schedule I or II drug is an offence before anything is made.
  • Fentanyl trafficking carries an additional specification that can add three to eight mandatory years on top of the sentence.
