The Helmet And The Novice Year
ORC 4511.53 — who has to wear one, and the year that follows a new endorsement
Ohio is not a universal helmet state and it is not a no helmet state either. It has a rule that turns on two things about the rider, and one of them is temporary, which is why two riders side by side can be under different obligations on the same road.
Who must wear one. No person who is under the age of eighteen years, or who holds a motorcycle operator's endorsement or licence bearing a novice designation, operates a motorcycle on a highway, or is a passenger on a motorcycle, unless wearing a protective helmet approved by the United States department of transportation on the person's head.
The passenger of a rider in that position wears one too. No other person is a passenger on a motorcycle operated by such a person unless similarly wearing a protective helmet. The obligation follows the rider, so a passenger who is over eighteen and holds a full endorsement of their own still wears a helmet where the person operating the machine is under eighteen or carries the novice designation.
The novice designation lasts a year. The novice designation is effective for one year after the date of issuance of the motorcycle operator's endorsement or licence. It is a period measured from a date printed on a card rather than from any test or any number of miles, which makes it one of the few rules on this site a person can work out exactly.
Eye protection is a separate requirement from the helmet and does not switch off with it. The helmet, safety glasses or other protective eye device conform with rules adopted by the director of public safety. A windscreen or windshield permanently attached to the motorcycle may serve as the eye protection the section requires.

A violation of the divisions this section sets out is a minor misdemeanour. Where a person has previously been convicted of or pleaded guilty to traffic offences, the degree rises in the pattern the traffic chapter uses generally.
This section sits in a statute that also governs bicycles and snowmobiles, and the divisions applying to each are different. Whether a particular helmet meets the federal standard, and what a citation carries in a particular court, are questions for a licensed Ohio attorney.
