Tobacco and Vapes Under Twenty One
ORC 2927.02 — the age is twenty one, and the law is written mostly against the seller
No one may give, sell or otherwise distribute cigarettes, other tobacco products, alternative nicotine products or rolling papers to a person under twenty one, or without first checking proof of age. Tobacco product is defined broadly: anything made or derived from tobacco or containing any form of nicotine, including an electronic smoking device and the liquid that goes in it, chewing tobacco, snuff and snus.

Proof of age means a card. Proof of age is a driver's license, a commercial driver's license, a military ID, a passport or a state ID card showing the buyer is twenty one or older. A store must also post a sign, in letters at least one half inch high, saying that sales to anyone under twenty one are against the law. Vapes, rolling papers and tobacco other than cigarettes sold online need independent age verification, and a delivery service carrying them must see proof of age.

| Who did whatSold or gave it to someone under twenty one, or without checking proof of age | What it isMisdemeanor of the fourth degree, third degree with a prior; the fine is up to $250 the first time, up to $500 the second, $500 the third, $1,000 the fourth and $1,500 after that |
| Who did whatLied about someone else's age to get it for them | What it isMisdemeanor of the fourth degree, third degree with a prior |
| Who did whatLied about their own age, at eighteen, nineteen or twenty | What it isMisdemeanor of the fourth degree, third degree with a prior |
| Who did whatA child under eighteen used, had or bought it | What it isA rule the child breaks, which the juvenile court may not treat as delinquent or unruly |
Under eighteen: forbidden, but not a delinquency. No child may use, possess, buy, try to buy, order, pay for, share the cost of or accept tobacco products unless a parent, spouse or legal guardian who is twenty one or older is with the child. But a juvenile court may not find a child delinquent or unruly for it. A child who gives false information to get tobacco may be ordered to do not more than twenty hours of community service, and products had in breach of the rule can be seized as contraband.
Between eighteen and twenty one, the rule that forbids possessing it is written for a child, and a child is a person under eighteen. So the age twenty one rule falls on whoever sells or hands it over, and on the young adult only for lying about their age to get it.
A parent can be the defense. It is an affirmative defense to the sale charge that the person under twenty one was with a parent, a spouse twenty one or older, or a legal guardian, or that the one who handed it over was that parent, spouse or guardian. An employee eighteen, nineteen or twenty may sell tobacco at work; an employer may not let an employee under eighteen sell it.
Where smoking and vaping are allowed at all is a different law, on its own page, and a school's own discipline rules are separate again. A particular charge is a question for a licensed Ohio attorney.
