A Dangerous Dog
ORS 609.098 — a serious injury without provocation, a repeat, or use as a weapon
- Without provocation and aggressively, seriously injures or kills a person
- Acts as a potentially dangerous dog again after an earlier finding against its keeper
- Is used as a weapon in a crime
A dog is dangerous under the section if it does any of those. A keeper who, with criminal negligence, fails to prevent the dog from doing so commits the crime of maintaining a dangerous dog.
