ORS 646A.404 — a new vehicle or a refund, less an allowance for use
Replace or refund. If the manufacturer and its dealers cannot, after a reasonable number of attempts, fix a defect that substantially impairs a new vehicle's use, market value or safety, the manufacturer replaces it with a new vehicle, or takes it back and refunds the full price and collateral charges, less a reasonable allowance for use.
For most vehicles, the allowance is the mileage multiplied by the price and charges, divided by 120,000.
Where the manufacturer runs an informal dispute procedure meeting the federal rules and told the consumer of it, the consumer goes through it first. Its decision binds the manufacturer but not the consumer.
