The House That Skips Probate
ORS 93.955 and ORS 93.967 — a transfer on death deed, revocable, and changing nothing in life
A transfer on death deed is revocable, even if it says otherwise. While the owner lives it does not affect the owner's rights, including the right to sell or borrow against the property, the beneficiary's interest, any creditor's rights, or anyone's eligibility for public or medical assistance.
Revoking a recorded deed takes an acknowledged and recorded instrument before the owner's death: a new transfer on death deed, an instrument of revocation, or a deed transferring the property.
