A Small Estate

20 Pa.C.S. 3102 — distribution on petition when the personal property is $50,000 or less

In Pennsylvania, when a person dies domiciled in the Commonwealth owning property, apart from real estate and certain payments to family and funeral directors, with a gross value of $50,000 or less, the orphans' court division of the county may, on petition of any party in interest, direct distribution to the people entitled to it, whether or not letters have been issued or a will probated.

  • The decree lets transfer agents, registrars and others recognize the named people without an administration.
  • Owning real estate, whatever its value, does not limit the court's power to distribute the personal property.
  • Within one year after the decree, any party in interest may petition to revoke it for an improper distribution.
