Controlled Substance Act 13.7 — immunity for reporting an overdose, giving a name, and staying
In Pennsylvania, a person may not be charged with the possession offenses the section lists, or with a probation or parole violation, if police learned of them only because the person brought someone having an overdose to a police agency, a campus security office or a health care facility, or because all of these are true:
- The person reported the overdose in good faith to police, 911, campus security or emergency personnel, reasonably believing someone needed immediate care to prevent death or serious injury.
- The person gave their own name and location and cooperated.
- The person stayed with the one needing care until help arrived.
The person who overdosed shares the immunity when the one who reported or brought them qualifies. It does not reach information police had before or apart from the call, delivery or distribution of drugs, drug delivery resulting in death, or any other crime.
