Open Container
75 Pa.C.S. 3809 — driver and passengers, a summary offense
In Pennsylvania, an operator or an occupant of a motor vehicle on a highway may not possess an open container of alcohol, or drink alcohol, or consume a controlled substance, in the vehicle. A violation is a summary offense.
The section does not apply to passengers in the passenger area of a bus, taxi, limousine or other vehicle used mainly to carry people for pay, or to someone in the living quarters of a house coach or house trailer.
