A Gun and a Drink
R.I. Gen. Laws § 11-47-52 — carrying or transporting any firearm while intoxicated is unlawful, and a complaint has thirty days
No firearm while intoxicated. It is unlawful to carry or transport any firearm in the state when intoxicated or under the influence of intoxicating liquor or narcotic drugs.
The section names no penalty of its own. The weapons chapter's general penalty, for a violation not otherwise specified, is a fine of not more than $1,000, or imprisonment for not more than five years, or both.
A complaint under this section has to be brought within thirty days after the offense.
Transporting covers a firearm in a vehicle, not only one on the person. A particular case is a question for a licensed Rhode Island attorney.
