When They Take Your Property

R.I. Gen. Laws § 21-28-5.04 — property used in drug dealing, and no forfeiture from an owner who did not know

Property and money used in, or bought with the proceeds of, the drug manufacturing and dealing offenses are seized and forfeited: vehicles, vessels, aircraft, real estate and cash among them.

An owner who did not know. No property or money is forfeited unless the owner knew, actually or constructively, and consented to the illegal act.

Cash found close to forfeitable drugs, dealing equipment or records is presumed to be drug money, and the burden of proof is on the claimant to show otherwise.

Forfeiture has its own procedure and deadlines. A particular seizure is a question for a licensed Rhode Island attorney.
