Grandparent Visitation
SDCL § 25-4-52 — reasonable visitation in the child's best interests, for grandparents and great-grandparents
- The visitation will not significantly interfere with the parent and child relationship.
- The parent or custodian has denied or prevented reasonable visits.
The circuit court may grant grandparents reasonable visitation, if it is in the grandchild's best interests and one of those is true. Grandparents include great-grandparents.
A parent's own decisions about a child carry great weight in court. A particular case is a question for a licensed South Dakota attorney.
