The Car Seat Rules
SDCL § 32-37-1 — a child restraint under five years of age, or a seat belt for a child of forty pounds
A driver carrying a child under five years of age secures the child in a child passenger restraint system according to the manufacturer's instructions.
Forty pounds. A child under five years of age who weighs at least forty pounds may be secured in a seat belt instead.
A driver who does not do so commits a petty offense.
