The Motorcycle Helmet
SDCL § 32-20-4 — a helmet for a rider or passenger under eighteen years of age, and no requirement in the section for adults
No person under eighteen years of age may operate or ride on a motorcycle on a public street or highway without a protective helmet meeting the federal standard.
The operator's duty too. No one may operate a motorcycle carrying a passenger under the age of eighteen who is not wearing a helmet. A violation is a Class 2 misdemeanor.
