Thrown Out Of A Hotel
SDCL § 43-32-37 — the reasons a hotel, campground or RV park may eject a guest without refunding the rent
- Not paying the charges.
- Disorderly conduct, or complaints from other guests.
- Using the premises for an unlawful act.
- Not being a registered guest, or exceeding the occupancy limit.
- Breaking a rule posted at the desk or in the room.
Those are among the reasons a hotel, campground or RV park may eject a person without returning the rental payment, under its cancellation policy.
Not a pretext. No posted rule may authorize ejecting or refusing service in violation of the state's discrimination law.
