Renting To Own It

Va. Code 59.1-207.23 — five days or two to reinstate, and twenty-one or forty-five after the goods go back

The short window. A consumer who misses a payment may reinstate the agreement, without losing any rights or options, by paying all past due rental charges, the reasonable costs of pickup and redelivery if the property was picked up, and any late fee, within five days of the renewal date when paying monthly, or two days when paying more often.

After the goods go back. A consumer who returned or voluntarily surrendered the property during that window may reinstate for not less than twenty-one days after the return, or not less than forty-five days if two-thirds or more of the payments to ownership have been made.

Repossession does not end it. A lessor may attempt to repossess during the reinstatement period, but that does not affect the right to reinstate, and on reinstatement the lessor provides the same property or a substitute of comparable quality and condition.

The disclosures the agreement must carry, and the remedies for a violation, are set out in other sections that are not on this page. Whether a particular agreement can still be reinstated is a question for a licensed Virginia attorney.
