Va. Code 46.2-904.1 — a bicycle's rights, and a helmet on class three

In Virginia, an electric power-assisted bicycle and its operator have all the rights and privileges, and all the duties, of a bicycle and its operator, and it is not subject to the rules on driver's licenses, registration, title, financial responsibility or license plates.

A helmet on class three. Each operator and passenger of a class three electric power-assisted bicycle must wear a properly fitted and fastened bicycle helmet. Failing to wear one is not negligence and may not be considered in mitigation of damages.

Where it may be ridden. It may be ridden where bicycles are allowed, including streets, shoulders, bicycle lanes and shared-use paths, but a locality or state agency may prohibit class one or two on a path after notice and a hearing if it finds that necessary for public safety or compliance with other laws, and may prohibit class three on a path.
