Va. Code 18.2-266.1 — 0.02 to under 0.08 is a Class 1 misdemeanor with a year's license loss
0.02 to under 0.08. It is unlawful in Virginia for a person under 21 to drive after illegally consuming alcohol, and a blood alcohol concentration of 0.02 percent or more but under 0.08 by chemical test is a violation.
It is a Class 1 misdemeanor. The punishment includes losing the license for one year from conviction, and a mandatory minimum fine of $500 or 50 hours of community service. A restricted license may be issued with an ignition interlock for not more than one year.
