Disorderly Conduct
W. Va. Code § 61-6-1b — loud or violent conduct in a public place that continues after an officer says to stop
After a request to stop. Disturbing the peace of others in a public place by violent, profane, indecent or boisterous conduct or language, or by unreasonably loud noise meant to annoy or alarm, is disorderly conduct only if the person persists after a law-enforcement officer asks them to desist.
Public places include state property, a mobile home park, a public parking area, the common area of an apartment building, and a shopping center. It is a misdemeanor, with jail for twenty-four hours or a fine of not more than $100.
The section says it is not to deter the lawful and orderly public right to demonstrate. A particular charge is a question for a licensed West Virginia attorney.
