Medical Cannabis
W. Va. Code § 16A-3-2 — lawful with a certification and an ID card, in pills, oils, tinctures and patches
Using or possessing medical cannabis is lawful only as the act provides, dispensed to a patient certified by a practitioner with a valid ID card from the bureau, or to a caregiver with a card.
- Pills, oils, tinctures, liquids and dermal patches.
- Gels, creams and ointments.
- A form for vaporization, but not dry leaf or plant unless the bureau's rules allow it.
Carry the card. A patient or caregiver carries the ID card whenever they have medical cannabis, and keeps unused cannabis in its original package.
A caregiver may serve no more than five patients, and a patient may name up to two caregivers. A particular question is one for a licensed West Virginia attorney.
