W. Va. Code § 62-1A-10 — on a traffic stop, probable cause, or consent in writing or on an audio recording

  • Probable cause or another lawful basis for the search.
  • The operator's written consent on the form the rules set.
  • The operator's oral consent, evidenced by an audio recording.

An officer who stops a vehicle for a traffic misdemeanor may not search it without one of those. A handwritten consent meeting the requirements will do if no form or recorder is available.

What the form says. The consent form states that the operator understands they may refuse consent, is giving it freely and voluntarily, and may withdraw it at any time during the search.

The recording rule does not apply where a court finds reasonable suspicion of danger to the officer kept the consent from being recorded. A particular search is a question for a licensed West Virginia attorney.
