Seat Belts
W. Va. Code § 17C-15-49 — the driver, everyone in front, and back seat riders under eighteen
No one may drive a passenger vehicle on a public street or highway unless the driver, every front seat passenger, and every back seat passenger under 18 years of age is wearing a safety belt.
Twenty five dollars, no points. The fine is $25, no court costs or other fees may be added, and no points go on the driving record.
The rule does not cover a rural mail carrier making deliveries, or a rider whose disability, certified by a physician, would make a belt inappropriate.
Children still need the car seat the separate child passenger section requires. A particular ticket is a question for a licensed West Virginia attorney.
